Terms + Conditions and Rental Agreement

Thank you for choosing Burnside Baby Hire (BBH). These Terms & Conditions form the Rental Agreement between Burnside Baby Hire (“we”, “us”, “our”) and you, the customer (“you”, “your”). By placing an order, you agree to the following:

1. Booking & Payment

1.1. All hire bookings must be made through our website or via written confirmation from BBH.
1.2. Full payment of the hire fee is required at the time of booking.
1.3. No bonds or holds are taken; however, your card details are securely stored (encrypted) for the duration of the hire.
1.4. If “pay later” services are used (e.g., Afterpay, PayPal), you will receive a link in your confirmation email to securely store a card for incidental charges. No payments are taken unless required under this agreement.

2. Hire Period

2.1. Your hire begins on the date the items are delivered, collected, or otherwise made available to you and ends on the date arranged for return or collection.
2.2. Late returns incur a daily fee equal to the pro-rated daily hire rate until the item is returned or collected.
2.3. If you need to extend your hire, please contact us as early as possible. Extensions are subject to availability.

3. Delivery, Collection & Set-Up

3.1. Delivery is available within our service radius. Delivery fees depend on location and will be confirmed at checkout or by quote.
3.2. You must provide accurate delivery information, including accommodation details if travelling to Adelaide.
3.3. If you select our Set-Up service, BBH will assemble items in accordance with manufacturer instructions.
3.4. You are responsible for checking that items are safely and appropriately placed before use.

4. Condition of Hire Items

4.1. All items are cleaned, sanitised and safety-checked prior to hire.
4.2. You agree to return the items in a similar condition to when you received them, allowing for fair wear and tear.
4.3. Items must not be altered, tampered with, or repaired by you unless expressly authorised by BBH.

5. Proper Use & Safety Requirements

5.1. You agree to use all items strictly in accordance with the manufacturer’s guidelines and intended purpose.
5.2. You must read and follow all instructions, weight limits, age limits, set-up videos and manufacturer warnings.
5.3. Items must not be used in unsafe environments or ways, including (but not limited to):

  • placing items on elevated surfaces (e.g., bouncers on tables)
  • exceeding weight or height limits
  • using car seats without correct installation
  • modifying harnesses or safety features
  • using prams or strollers with non-recommended accessories

5.4. Burnside Baby Hire takes no responsibility for injury or harm resulting from misuse, incorrect installation, failure to follow manufacturer guidelines, or use outside the intended purpose of the item.

6. Liability & Indemnity

6.1. You acknowledge that baby equipment has inherent risks if not used properly.
6.2. BBH is not liable for any injury, loss, damage or incident arising from your use or misuse of the hired items.
6.3. To the maximum extent permitted by law, you agree to indemnify and hold BBH harmless against all claims, costs or liabilities resulting from:

  • improper use
  • negligence
  • unauthorised alterations
  • failure to supervise a child
  • transport or travel with the items

7. Loss, Damage & Replacement

7.1. You are fully responsible for the item(s) while they are in your possession.
7.2. If an item is lost, stolen, damaged beyond repair, or not returned, you authorise BBH to charge your stored card for:

  • the full replacement cost of the item, OR
  • the repair cost (as assessed by BBH), whichever applies.

7.3. Examples of chargeable damage include:

  • tears, stains, mould or excessive dirt
  • water damage
  • bent frames
  • broken parts or missing components
  • misuse leading to structural damage

7.4. Minor marks and fair wear and tear will not incur charges, we understand babies and travel happen.

8. Cleaning

8.1. BBH handles all professional cleaning and sanitising after return.
8.2. A cleaning or repair fee may apply if items are returned excessively soiled, including:
  • vomit
  • urine or faeces
  • mould
  • chewing or gnawing damage
  • sand or debris in mechanisms
9. Car Seats, Capsules & Safety Installations

9.1. Car seats and capsules must be installed in line with Australian Safety Standards and manufacturer instructions.
9.2. BBH may provide installation guidance, but you are solely responsible for ensuring the seat is safely and correctly installed.
9.3. BBH accepts no liability for improper installation or use of car restraints.

10. Cancellations & Refunds

10.1. Cancellations made more than 1 week before the hire start date may be eligible for a refund, minus any applicable fees.
10.2 Cancellations between 1 week to 48 hours before hire start date will incur 50% of the booking fee.
10.3. Cancellations within 48 hours of the hire start date are non-refundable.
10.4. No refunds are given for early returns or unused hire time.

11. Photography & Marketing (Optional)

11.1. With your permission, BBH may feature customer images (e.g., holiday hires, set-up photos) in marketing materials.
11.2. Permission is optional and can be withdrawn anytime.

12. Privacy & Card Security

12.1. Your personal information is used only for booking, delivery, billing and service communication.
12.2. Card details are encrypted and stored securely by our payment processor for the duration of your hire.
12.3. We do not store or handle full card details directly.

13. Governing Law

13.1. This agreement is governed by the laws of South Australia.
13.2. Any disputes will be handled under SA jurisdiction.

14. Acceptance of Terms

By completing your booking or accepting delivery of hire items, you confirm that:

  • you have read and understood these Terms & Conditions;

  • you agree to use all items safely and appropriately;

  • you accept responsibility for the hired items while in your possession; and

  • you authorise BBH to charge your stored card for any damage, loss or late fees outlined above.
